Terms and Conditions for Tia’s Sweet Tooth LLC

 

The following terms and conditions apply to all orders with Tia’s Sweet Tooth (hereinafter referred to as “Bakery”), regardless of the presence of a signed contract. By placing an order and providing payment, you (hereinafter referred to as “Client”) enter into a contract with Bakery when your order is accepted and payment is confirmed.

 

1. Custom Orders, Payment, and Pickup

 

    •    Order Confirmation: Bakery specializes in creating unique and personalized cakes, cupcakes, and desserts. Once a payment is received, Client agrees to specific colors, flavors, designs, sizes, and servings as discussed with Bakery staff.

    •    Payment: Orders under $200 require full payment upfront. Orders over $200 require a 50% non-refundable deposit, with the remaining balance due one week prior to the order’s pickup/delivery date. All orders must be paid in full before pickup or delivery.

    •    Acceptance: Acceptance of the products at pickup or delivery signifies Client approval of all specifications discussed. Concerns must be raised immediately upon pickup or at delivery, and should be resolved before products leave Bakery’s possession.

 

2. Delivery

 

    •    Fee Structure: A flat fee of $40 applies for deliveries within a 30-mile radius. Additional distances incur a fee of $1.50 per mile beyond 30 miles.

    •    Liability: Bakery maintains responsibility for products while in transit if Bakery staff handles delivery. Once delivered or picked up, the condition of the products is the Client’s responsibility.

 

3. Cancellations

 

    •    General Policy: Changes or cancellations must be made no later than one week before the scheduled pickup/delivery date. Custom orders not picked up or canceled less than one week before the pickup/delivery date are non-refundable.

    •    Unexpected Cancellations: In the event of severe weather or other unforeseen circumstances, Bakery may need to reschedule. The 50% deposit remains non-refundable; however, if the order is fully paid, a 50% refund will be issued if rescheduling is impossible.

 

4. Allergens

Bakery products may contain or come in contact with milk, wheat, nuts, soy, and other allergens. Bakery makes no guarantees regarding the absence of allergens. Client agrees to hold Bakery harmless for any allergic reactions or injury resulting from consumption or contact with Bakery products.

 

5. Structural Supports in Cakes

To maintain the integrity of cakes, Bakery may use wooden dowels or floral wire for support. Client agrees to consult with Bakery regarding the location of support mechanisms and holds Bakery harmless for any injury from contact with or consumption of these supports.

 

6. Photography, Video, and Social Media

Bakery reserves the right to photograph and/or record any product and use such media for promotional purposes without compensation to the Client. Client agrees to these terms by placing an order.

 

7. Perishable Products and Handling

Bakery products are perishable and may be affected by improper storage, extreme temperatures, or other factors. Products are best served within 8 hours of pickup. Bakery staff can provide specific storage recommendations upon request. Client acknowledges responsibility for the condition of the products post-pickup and holds Bakery harmless for any degradation in product quality due to improper handling.

 

8. Returns, Exchanges, and Transportation

 

Due to the perishable nature of our products, all cake and cupcake sales are final and non-refundable. Each order is crafted with care and precision to meet our high standards of quality. However, if there is an issue with your order, please contact us within 24 hours of pickup or delivery, and we will make every effort to address your concerns.

No Returns or Exchanges
We do not accept exchanges, refunds, or returns on any food items. Once products have left our care, we cannot accept responsibility for any changes in the condition of the items. All responsibility for the care and quality of the products shifts to the client upon pickup or delivery.

Transportation and Storage Tips
To help ensure that your items arrive safely and remain in peak condition, we recommend the following precautions:

  • Avoid leaving cakes, cupcakes, or other desserts in a vehicle for prolonged periods, especially in warm or hot weather.

  • Secure large or tiered desserts carefully to prevent movement during transit.

  • Keep all desserts shielded from direct sunlight, excessive moisture, and strong odors to maintain their best quality.

 

9. Force Majeure

Bakery shall not be liable for failure to fulfill any terms of this agreement due to events outside its reasonable control, including but not limited to natural disasters, strikes, or other disruptions beyond Bakery’s ability to mitigate.

 

By placing an order with Tia’s Sweet Tooth, Client acknowledges and agrees to the above terms and conditions.
